Terms of Service

These terms govern your use of the FestiClip app and website (the "Service"), provided by FestiClip B.V., registered in Amsterdam. By creating an account or using the Service, you agree to these terms.

1. Your account

You must be at least 16 years old (or the minimum age required in your country) to create an account. You're responsible for keeping your login credentials safe and for everything that happens under your account.

2. The clips you upload

You keep ownership of any clip you upload. By uploading, you grant FestiClip a worldwide, non-exclusive, royalty-free licence to host, display, transcode, and share that clip with other users of the Service in line with the visibility settings you choose, and to feature it in aftermovies stitched together by the Service. This licence ends when you delete the clip or your account, except where the clip has already been included in a downloaded aftermovie.

3. What you may not upload

• Content that you don't have the right to share.
• Content that is illegal, threatening, hateful, or invades someone's privacy.
• Footage that focuses on identifiable individuals without their consent in a way that's harmful or harassing.
• Spam, advertising, or attempts to manipulate ranking signals.

4. Removal and account suspension

We may remove clips and suspend or close accounts that breach these terms or our Content Guidelines, including in response to valid legal requests. Where possible we'll let you know why.

5. Service availability

We work hard to keep FestiClip running, but the Service is provided "as is". We don't guarantee uninterrupted availability, and we may change or discontinue features.

6. Liability

To the extent permitted by law, FestiClip is not liable for indirect or consequential damages, lost profits, or lost footage. Nothing in these terms limits our liability for fraud, gross negligence or any liability that cannot be excluded under Dutch law.

7. Festival organisers and brands

Separate commercial agreements apply to organisers and brands using FestiClip's analytics or partnership features. These terms still apply to any individual account used by your team.

8. Changes

We may update these terms from time to time. We'll notify you of material changes through the app at least 30 days before they take effect.

9. Governing law

These terms are governed by the laws of the Netherlands. Disputes will be heard by the courts of Amsterdam, unless mandatory consumer protection rules say otherwise.
